Legal framework · intended uses
Light above people
Weddings, parties and concerts are intended use cases. Directly overhead operation needs an assessment of the real gathering and the complete system; it is not already cleared by its low electronic-core mass.

The relevant distinction
A crowd is a condition
The EU UAS rules define an assembly of people by whether density prevents people from moving away, rather than by a fixed guest count. That framework prohibits flight over assemblies in the open category, including its lightest subcategory. Luna’s non-propelled tethered design follows a different scope assessment under Annex I of Regulation (EU) 2018/1139: the drone rule is neither automatically imported nor a basis for declaring overhead operation exempt.
Regulation (EU) 2019/947: Article 2(3), Article 4(1)(c), UAS.OPEN.020
Rules of the air matter too
The Annex I route does not automatically exclude the common rules of the air. SERA.3101 protects persons and property; SERA.3105 addresses minimum heights over congested areas and outdoor assemblies, while SERA.5005(f) sets VFR minima. ENAC’s RAIT complements this framework nationally. Their coordination with the specific low tethered-aerostat procedure in ATM-05B section 7.3 is not resolved by the text we found. This is why Q3 asks ENAC which prohibition or specific permission applies, rather than assuming overhead use lawful or declaring the entire product banned.
Compare the intended setting
Wedding or party
A private invitation does not turn guests into trained operators or eliminate the risk beneath the system. Assess actual density, freedom to move, children, evacuation routes and the entire fall or tether-failure envelope.
The actual overhead case
The solid core below 250 g excludes the envelope, gas, tethers, cables and ground apparatus: it cannot prove harmlessness of the complete installation. The remaining national-rule question and any event-specific restrictions must be resolved on the actual configuration. Until those conditions and the safety evidence are established, this website does not present overhead crowd use as available or authorised.

The organiser and responsible technicians assess the applicable public-entertainment and venue-safety procedures, fire prevention, evacuation, electrical installations and temporary structures. A private wedding, an outdoor concert and a public-entertainment venue do not share one automatic permit route. Aviation clarification does not replace these checks.
