Frequently asked questions

What happens when Allegato B applies because a minor is involved?

Allegato B prevails with absolute priority. No Hobby/DIY permission, Tool1, handover, or informal communication under Allegato M permits the minor to use tools, work on systems, enter technical areas, or take part in operational activities. Allegato M may continue to apply only to an authorised adult who keeps the minor effectively separated from the activity and its risks.

May I carry out DIY projects or small repairs?

Only if you are an adult, you already have lawful access under a separate instrument, Attachment B does not prohibit the activity, and the 'Hobby Approval (DIY)' option is validly enabled. The activity must remain low-risk, reversible, and within the specifically authorised scope; it may not involve structural or system changes. A minor may not rely on this permission.

Can I borrow tools from the Company?

Only after the Reference Agreement is effective and includes Attachment M, the exact asset is marked as loanable in the Tool Register, and a bilateral Tool1 identifies its unique code, applicable verified instructions or the reasoned absence of a separate manual, inspection, authorised use, place, duration, safeguards, consumables, energy, deposit, handover, and return terms. The Signatory must submit the unaltered Italian source PDF and the completed and signed Italian copy; the Company must apply its qualified electronic or digital signature to the copy already signed by the Signatory before handover. There are no authorising categories or kits: each asset requires its own Tool1. A request or physical handover alone does not authorise use. If Attachment B applies, Tool1 cannot authorise use by the minor.

Does the Company provide safety equipment (PPE)?

For an autonomous Hobby Activity, the authorised adult ordinarily provides the PPE indicated by the manufacturer and the applicable rules. No asset may be used without adequate protections. Any non-waivable duty attributable to the Company under law, custody, instructions issued, or the actual activity remains unaffected.

What happens if I get injured while using a borrowed tool?

For an authorized adult, liability is determined by the applicable law and the signed package. Misuse, lack of competence, and breach of safety rules remain attributable to the user, but no clause excludes non-waivable liability, willful misconduct, gross negligence, or known undisclosed hazards. A minor is not authorized to use the tools when Allegato B applies.

What if a simple hand tool has no separate manual?

It still requires its own Tool1. Before handover, the Company checks identity, markings, any available manufacturer information, intended use, condition, foreseeable risks, and necessary safeguards. Tool1 may then record with reasons that no separate manual exists, but must still state pre-use checks, limits, PPE where applicable, handover, and return. Absence of a manual does not by itself prove safety or authorise use.

Can I have a friend help me with my hobby projects?

No, unless the third party has their own prior, specific, and valid authorisation. Knowing introduction of an unauthorised person into an operational area may justify immediate precautionary suspension and may amount to Serious Breach where it creates a concrete risk or circumvents access controls. Final measures follow Attachments T and F.

What is considered 'unauthorized construction' (Abuso Edilizio)?

Any unauthorised work affecting volumes, structures, systems, or cadastral layout is prohibited. Even work potentially classed as 'free building' requires the specific contractual authorisation provided by Attachment M. The Company may report facts to the competent authority where required by law or supported by concrete evidence of wrongdoing; the authority determines the legal classification.

Will someone supervise me while I work?

An authorized adult carries out the hobby activity autonomously and must be competent and responsible for compliance with the safety rules. This does not exclude mandatory duties or duties connected with custody actually exercised. If a minor is involved, Allegato B prevails and the activity must be suspended whenever the minor cannot be effectively separated from the area and the risk.

Is this a work relationship?

Attachment M governs only personal, optional, autonomous, and unpaid hobby activities, without assigned tasks, hours, required results, direction, or coordination. It cannot be used to disguise employment, an internship, professional collaboration, or volunteering; if the actual facts differ, the activity must stop and be governed by the appropriate lawful instrument.

How do I report a broken tool?

Immediately stop using it, secure it if this can be done safely, and notify the Company through a traceable official channel. Any repair or replacement charge requires documented damage, a causal link to attributable conduct, reasonable quantification allowing for wear and value, and the objection procedure under Attachment F.

Are consumables and electricity included?

Only if the specific Tool1 says so. For every authorised asset, Tool1 states which consumables are supplied, whether they are free, reimbursable at documented cost, partly charged, or excluded, and whether electricity is included, metered, allocated by an agreed calculation, or subject to a fixed contribution. Silence does not create an entitlement.

Can an additional deposit be required for a tool?

Yes, but only when the amount, purpose, payment status, release conditions, and accounting treatment are expressly stated in Tool1 and coordinated with Attachment F. A deposit is security, not an automatic penalty or a cap on proven liability, and any deduction remains subject to evidence, notice, and an opportunity to respond.

Why does Tool1 ask for my experience and the specific reason for use?

Experience facts help the Company assess whether training, a practical test, or supervision is necessary and are described under the Signatory's contractual responsibility, limited to facts directly known by the Signatory. They are neither a self-certification nor a substitute declaration and do not certify competence. The project reason is a separate contractual request that lets the Company delimit operations, materials, place, and duration.
